Terms of Use

1. Overview and acceptance

These Terms govern your access to and use of the TerraRange website (terrarange.com), the TerraGauge app and software, and your purchase and use of the TerraGauge soil probe and associated hardware (together, the "Service"). By accessing the website, purchasing a TerraGauge, or using the app, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time by posting the revised version on our website, with an updated "last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes affecting your rights regarding purchased hardware will be communicated to existing customers by email where reasonably practicable.

2. Eligibility

By using the Service, you represent that you are at least the age of majority in your state, province or country of residence, or that you have the consent of a parent or guardian.

3. Product description

TerraGauge is a soil monitoring device intended to provide real-time, directional soil data for agricultural, horticultural and gardening use. It is a consumer/prosumer diagnostic tool, not a certified laboratory testing service, and does not replace professional soil analysis.

4. Measurement types and accuracy

Temperature, Moisture and EC are measured directly by the probe. pH, Salinity, Nitrogen, Phosphorus and Potassium are estimated values, calculated from those direct readings using TerraGauge's algorithm, and are not laboratory-grade measurements. Estimated values are best used to track relative change and trends over time, not as precise standalone figures.

TerraGauge is designed and best suited for typical agricultural soils, generally in the pH 6–8 range. Readings outside this range, or taken in atypical soil conditions, should be treated as less reliable indicators only.

5. No professional advice

TerraGauge does not provide agronomic, horticultural, or professional soil management advice. Nothing in the app, website, or accompanying materials constitutes a recommendation to take any specific fertilising, irrigation, remediation, or crop management action. Before making decisions with significant financial, agricultural, or compliance consequences, you should seek advice from a qualified agronomist or soil scientist and confirm results with certified laboratory soil testing.

6. Your responsibility and permitted use

You are solely responsible for all decisions made using TerraGauge data, and for verifying its suitability for your specific use case, soil type, and crop. You agree to use the Service only for lawful purposes and in accordance with the included instruction manual, including proper probe handling, calibration expectations, and moisture-threshold requirements for reliable readings. You must not reverse-engineer, resell as your own, or use the Service to build a competing product.

7. Website content accuracy

Material on the website is provided for general information only and may not always be complete, current, or error-free. We may correct errors, update information, or modify content at any time without notice or obligation to do so. Any reliance you place on general website information (as distinct from live readings taken by your own device) is at your own risk.

8. Orders, payment and subscriptions

Hardware orders. Prices for TerraGauge hardware are shown at checkout and are subject to change without notice for future orders. We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or stock unavailability, and will notify you and refund any payment already made if we cancel an order.

TerraGauge Pro subscription. TerraGauge Pro is an optional, separately purchased subscription (monthly or annual) that unlocks additional features in the app. Subscriptions automatically renew at the then-current price until cancelled. You may cancel at any time via the app's Settings screen; cancellation stops future renewal but does not refund the current billing period, and Pro features remain active until the end of the period already paid for. We may change Pro pricing or features for future billing periods with reasonable notice.

Billing information. You agree to provide current, complete and accurate payment and account information and to promptly update it if it changes.

9. Limitation of liability

To the maximum extent permitted by law, TerraRange Pty Ltd's total liability for any claim arising from your purchase or use of TerraGauge or the Service (whether in contract, tort/negligence, or otherwise) is limited, at our option, to: (a) the purchase price paid for the product or subscription giving rise to the claim; or (b) the repair or replacement of the product.

TerraRange Pty Ltd is not liable for indirect, consequential, or special loss, including but not limited to crop loss, yield loss, lost profits, or business interruption, arising from reliance on TerraGauge data or use of the Service.

Your rights are not affected. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law, or equivalent consumer protection laws in the country in which you purchased or use TerraGauge. Where such laws apply and cannot be excluded, our liability is limited (where permitted by that law) to, at our option, the repair or replacement of the goods, supply of equivalent goods, or the cost of doing so.

10. Warranty

TerraGauge hardware is covered by any warranty required by applicable consumer law, including the Australian Consumer Law's mandatory consumer guarantees (acceptable quality, fitness for purpose, matching description). Beyond those mandatory guarantees, the Service and website content are provided "as is" and "as available," without additional express warranties, to the extent permitted by law. Estimated data values (see Section 4) are provided as indicative tools, not warranted to any level of laboratory accuracy.

11. Indemnity

You agree to indemnify and hold harmless TerraRange Pty Ltd and its officers, employees and contractors from any claim, loss, damage or expense (including reasonable legal costs) arising from: (a) your breach of these Terms; (b) your misuse of the product, including use outside its intended agricultural/horticultural purpose or disregard of the included instructions; or (c) decisions made by you or a third party in reliance on TerraGauge data without the verification steps described in Section 5, to the extent permitted by law.

12. Intellectual property

The TerraGauge app, software, algorithms, website content, trademarks, and branding are owned by or licensed to TerraRange Pty Ltd. Purchasing hardware grants you a personal, non-exclusive, non-transferable licence to use the app and software with your device for its intended purpose. You may not copy, modify, distribute, or create derivative works from the app, software, or website content without our express written permission.

13. Third-party tools and links

The Service may include access to third-party tools or links to third-party websites, provided "as is" without warranty from us. Use of third-party tools or sites is at your own risk and subject to their own terms; we are not responsible for third-party content, accuracy, or conduct.

14. User submissions

If you submit reviews, feedback, or other content to us, you grant TerraRange Pty Ltd a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for marketing and product improvement purposes. You must not submit content that is unlawful, infringing, or misleading. We may remove submitted content at our discretion but are not obligated to monitor it.

15. Personal information

Our collection and use of personal information is governed by our Privacy Policy, available at https://www.terrarange.com/en-au/pages/privacy-policy.

16. Prohibited uses

You must not use the Service for unlawful purposes, to infringe intellectual property rights, to transmit malicious code, or to harass or harm others. Violation may result in suspension or termination of your access to app features (including Pro subscription access), without affecting your rights regarding hardware already purchased under applicable consumer law.

17. Suspension and termination

We may suspend or terminate your access to app features, including Pro subscription features, if we reasonably believe you have breached these Terms. Suspension or termination of app access does not affect the direct-measurement functionality of the hardware itself, nor any consumer guarantee rights relating to the hardware.

18. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy and any policies referenced herein, constitute the entire agreement between you and TerraRange Pty Ltd regarding the Service, superseding any prior agreements or representations regarding its subject matter.

20. Governing law

These Terms are governed by the laws of Victoria, Australia, without prejudice to any mandatory consumer protection laws of your own country or state that apply to your purchase.
